Calculations for SUP-14-00312 Protest Petition

 

Protest petitions were filed in the City Clerk’s Office on December 1, 2014 pertaining to the referenced request for a special use permit for a new Verizon Wireless communications tower on the property addressed as 1725 Bullene Avenue.  The petitions have enough signatures of the record owners of property in the required notification area to constitute a valid protest petition.  The property owner notification list prepared by the Douglas County Clerk’s Office included parcels lying within 200’ of the property in the application request. 

 

There are sixteen (16) parcels captured within the required 200 feet notification distance of the property in the special use permit request.  The total area of the real property represented by these 16 parcels is 229,634.10 square feet (5.27 acres). The protest petitions received by the City were signed by owners of 12 parcels but only 9 of those parcels could be counted toward the determination of the petition’s validity.  Two property parcels in the protest petition are located outside the boundary of the 200 feet notification/protest distance and one property parcel was omitted because only one of the property owners of record signed the petition.

 

The total area represented by the 9 parcels counted in the petition is 55,582.23 square feet (1.28 acres) or approximately 24.29% of the total area of the real property within the notification boundary.  The protest petition is valid because it bears a sufficient number of property owner signatures within the required notification area to meet or exceed the minimum 20% of the real property required by City Code to constitute a valid protest petition. 

 

The attached map illustrates the properties within the protest area with owners who are protesting this special use permit request.
