RE:

PepperJax Grill Sidewalk Dining and Hospitality License and Site Plan SP-14-00365

Background

PepperJax Grill submitted a site plan for a sidewalk hospitality area and applied for a sidewalk dining and hospitality license for 919 Massachusetts Street.  Planning staff has reviewed the site plan and recommends approval (Staff Report).

Pursuant to City Code (6-1205, E), applicants must obtain written permission from all adjacent tenants and property owners declaring no objection to the issuance of the requested sidewalk dining license.  If the statements cannot be obtained, then the City Commission may hold a public hearing to determine whether or not to grant the license.

The applicant was unable to obtain one of the required signatures from adjacent property owners and tenants, and has requested a public hearing on the application.  The City Clerk’s Office has notified the applicant and adjacent property owners of the public hearing in accordance with the City Code.

Staff Recommendation

Conduct a public hearing on the application for a sidewalk dining and hospitality license for PepperJax Grill located at 919 Massachusetts Street and consider Site Plan SP-14-00365, submitted by Paul Werner Architects, for G & P LC, property owners of record.  Find that it is within the public interest to approve the sidewalk dining and hospitality license for 919 Massachusetts Street and Site Plan SP-14-00365, if appropriate.
