RE:	2014 Arts Center Fall Fundraiser

The city has received a street event permit and a request to close and use the top deck of the New Hampshire parking garage (see attached aerial photo) on Saturday September 13, 2014 from the Lawrence Arts Center for their 2014 Arts Center Fall Fundraiser event.

The top deck of the garage would be closed beginning 12:00 am on Saturday September 13, 2014 and remain close to vehicles until 11:59 pm on Saturday September 13, 2014. The event would take place on the top deck of the garage from approximately 5:30 pm to 9:30 pm on Saturday September 13, 2014.

In addition to this request they have also requested an ordinance allowing the sale, possession and consumption of alcohol in conjunction with the event.

The request to sell, possess and consume alcohol within the public right of way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113 and the event was found to be within 400 feet of a church or school. Pursuant to code requirements, staff has notified The Salvation Army that a public hearing regarding this request will be held on July 22, 2014 at the City Commission Meeting (See attached letter).

Possession and consumption of alcohol on the right-of-way is generally prohibited, unless the City Commission adopts an ordinance exempting an area from that prohibition. The attached Ordinance No. 9002 would temporarily allow the possession and consumption of alcohol on the top deck of the New Hampshire parking garage located at 927 New Hampshire Street during this event.

This application has been reviewed by Public Works, Police, Fire / Medical, Parks & Recreation, Downtown Lawrence, Inc., and Lawrence Transit without any comments or issues. Notice of this request and commission agenda pending action have been sent out to adjacent property owners (see notice).

ACTIONS

Conduct a public hearing regarding a distance limitation waiver request for the 2014 Arts Center Fall Fundraiser event to be held on the top deck of the New Hampshire Parking garage located at 927 New Hampshire Street on Saturday September 13, 2014.  Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and grant a distance limitation waiver.

Approve a street event permit and closure of the top deck of the New Hampshire Street parking garage for the use of the top deck for Saturday September 13, 2014 from 12:00 am to 11:59 pm for the Lawrence Arts Center Fall Fundraiser Event.

Adopt Ordinance No. 9002, allowing the possession and consumption of alcohol on Saturday September 13, 2014 from 12:00 am to 11:59 pm on the top deck of the New Hampshire parking garage located at 927 New Hampshire Street associated with the Lawrence Arts Center Fall Fundraiser Event; provided the sale, possession and consumption are pursuant to City of Lawrence and State of Kansas law.
