Background

 

As noted in a memo dated October 2, 2012, staff has experienced a long history of non-compliance at the property in regards to exterior yard and structure conditions. Staff condemned the house on August 18, 2011, which is still in the appeal process in District Court and a ruling is expected soon. 

 

Since the condemnation, staff has continued to receive neighbor complaints due to the structure not having siding and the overall appearance of a dilapidated structure. As a result of those complaints, staff presented Resolution No. 6997 (Unsafe or Dangerous Structure) on the consent agenda on October 2, 2012.  The resolution was adopted and the public hearing date was scheduled for November 13, 2012. 

 

Prior to the adoption of Resolution No. 6997, Mark Bradburn (owner) completed the following items which were noted by staff as significant issues observed during the condemnation that occurred on August 18, 2011.

 

 

Since the adoption of Resolution No. 6997, staff has confirmed there has been a decent amount of work occurring on the exterior of the house. The following pictures were taken on November 5, 2012 and illustrate the work completed as described below:

 

 

Due to these recent improvements along with the previous work being completed, it is staff’s opinion that the house does not meet the level of overall deterioration that staff always conveys to the City Commission when a resolution orders demolition is if repairs are not completed.  Therefore, staff is requesting to remove this item from the regular agenda for the November 13, 2012 City Commission meeting.

 

Staff recognizes the house remains blighted, however; there are property maintenance code violations that staff can pursue in that regard.  Staff will continue to monitor progress and take appropriate enforcement action if needed.
