How do I file a claim against the City?

All claims against the City of Lawrence are handled by the Risk Management Division. Claims for damages to or for loss or destruction of property or for personal injury must be submitted in writing as required by Kansas Statute under the Kansas Tort Claims Act (K.S.A.. 12-105b). Claims should be submitted on a City of Lawrence Claim form along with any relevant information pertaining to the claim allegations. Claims must include specific information such as the date, time, and location of the alleged event. In some instances the claimant may wish to, or be asked to, provide estimates or invoices for repair, pictures, or other documentation as deemed appropriate.

A City of Lawrence Claim Form may be requested of the Risk Management Division either by telephone, email, or in person.

Who will review my claim?

Generally, claims are investigated and reviewed by the Risk Manager. The City Manager, Assistant City Managers, and City Attorney may also participate in the review and determination.

How long will it take to review my claim?

Under the Kansas Tort Claims Act, the City has up to 120 days to review and make a determination, and a claim is deemed denied if no action is taken within 120 days. Most claims can be reviewed and a determination reached in far less than 120 days; however, the length of time to complete a claim review will vary based upon the complexity and circumstances of the allegation. Upon completion of the investigation and determination, the Risk Management Division will contact the claimant to advise of the outcome of the determination either by telephone or letter.

I drove over a pothole, will the City pay for damages to my vehicle?

Claims for damage to a vehicle as a result of driving over a pothole are not generally reimbursable. Periods of precipitation and subsequent thawing and freezing do contribute to the development of potholes, particularly at intersections and in low-lying areas where water frequently stands. The City of Lawrence Municipal Services and Operations Department operates an aggressive pothole response program with street crews specifically addressing reported potholes. Citizens can report a pothole 24-hours a day by calling, MSO Admin (832-7800) or completing the Pothole Report Form. Drivers should be aware of the potential for potholes, the presence of City repair crews on busy streets and slow down to prevent accidents.
