RE:	July 11, 2006 Agenda Item Vacation of Gas Line Easement Lot 2, Brackett School Addition

On July 11, 2006 the City Commission will hold a public hearing on the request to vacate a 25’ gas line easement in Lot 2, Brackett School Addition. Lawrence Board of Realtors is requesting vacation of this easement in order to build a parking lot as well as to cross the easement with a storm sewer.

Aquila is in the process of executing a release so there will be no question as to the validity of the vacation. The attached email from Mr. Chuck Hoag, Operations Manager for Aquila, states that the formal process will soon be done and the release will indeed be completed. No comments were received from other utilities.

Action Requested:

Open public hearing and, pending comments and discussion, approve Order of Vacation.
