1.0 Purpose
To protect the integrity of the Kansas River and Mud Creek Levee, in compliance with federal and state regulations, by establishing a formal process for the approval of excavation within the levee corridor (1000 feet of the levee centerline).
2.0 Policy for Excavation Approval
A. Excavation within 1000 feet of levee (landward or riverward)
Any excavation within 1000 feet of the centerline of the Kansas River and Mud Creek levee (landward or riverward) must comply with Kansas Statute 19-3309. The levee project sponsor is recognized as the City of Lawrence. The City Engineer or Public Works Director may authorize, in writing, excavation within the defined corridor. For excavation between 500 and 1000 feet of the levee centerline, the sponsoring agency has the responsibility to ensure the proposed excavation will not be detrimental or impair or endanger the function of the levee. Excavation within the “Critical Area” of the levee (500 feet landward or 300 feet riverward of the centerline) requires additional review, as outlined in 2.0 (B) of this policy.
B. Excavation within the “Critical Area” of the levee
The “Critical Area” of the levee is defined as 500 feet landward / 300 feet riverward of the centerline of the levee. Review of excavation within the critical area of the levee shall be completed by the sponsor (City) and submitted to the U.S. Corps of Engineers for approval. A complete set of plans and specifications will be submitted for review and comment. The Corps of Engineers will provide approval to the sponsoring agency (City). Approval will be issued to the applicant by the City Engineer or Public Works Director, in accordance with KSA 19-3309.
C. Scope of excavation
This policy pertains to any excavation or digging for any reason within 1000 feet of the levee centerline. Examples of excavation include, but are not limited to, new home construction, utility installations, serve line installations, and maintenance on existing facilities.
