RE:	License Agreement for Dale Willey Automotive, Inc.

Dale Willey Automotive, Inc. has acquired the property at 2828 Iowa Street (previously a car wash) and is expanding (see attached map).  There is a need to connect communications (fiber) between the two properties.  The conduit and fiber are proposed to be located in the Iowa Street Frontage Road right-of-way, parallel to the Frontage Road.

The license agreement allows the installation of the conduit and fiber.  The owner will be responsible for installation and maintenance as well as any relocation or removal costs in the event the City needs to use the right-of-way for the City’s purposes.

In consideration for the license the owner agreed to pay $1000 in compensation.

Action

Authorize the Interim City Manager to execute the license agreement with Dale Willey Automotive, Inc. for the use of the right-of-way on Iowa Street Frontage Road for the installation of conduit and fiber.
