RE:

Dedication of easement and vacation of right-of-way associated with Minor Subdivision, MS-15-00123, for Pinckney Addition, located at 810 W. 6th Street.

Background

Minor Subdivisions/Replats are land divisions that are reviewed and processed administratively. These items are placed on the City Commission agenda when easements or rights-of-way are being dedicated or vacated.  A Minor Subdivision for Pinckney Addition, MS-15-00123, was approved by the Planning Director on June 11, 2015 pending the City Commission’s acceptance of the dedication and vacation. The Minor Subdivision and Administrative Determination are attached with this memo for context; however, no action is necessary for the Minor Subdivision.

The Minor Subdivision replats multiple existing lots into two lots, and was necessary to accommodate a land transfer between the City and the USD 497. During the preliminary site plan review process for Pinckney Elementary School, it was determined that a portion of the school blacktop and playground areas were located in Clinton Park, which is city park property. The City Commission authorized the land transfer on June 2, 2015.

The Minor Subdivision proposes to vacate 10’ of right-of-way of Alabama Street, reducing the existing right-of-way from 80’ to 70’. After the reduction of right-of-way, Alabama Street will still meet the Subdivision Regulations of Section 20-810(e)(5).

There is also a dedication of a stormwater drainage easement associated with this Minor Subdivision. This is necessary to accommodate an existing stormwater line that is located along the west side of the property that runs through the USD property.

Action

Accept dedication of a stormwater drainage easement and vacate 10’ of right-of-way for Alabama Street associated with a Minor Subdivision, MS-15-00123, for Pinckney Addition, if appropriate.
