ORDINANCE NO. 9128

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 10 ACRES FROM RSO (SINGLE-DWELLING RESIDENTIAL-OFFICE) DISTRICT TO CN2 (NEIGHBORHOOD COMMERCIAL) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2015 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

COMMENCING AT THE NORTHWEST CORNER OF SECTION 10, TOWNSHIP 13 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN; THENCE ALONG THE NORTH LINE OF SECTION 10 N88°17'10"E, 722.05 FEET; THENCE S01°33'59"E, 684.68 FEET; THENCE ON A CURVE TO THE RIGHT WITH A RADIUS OF 500.00 FEET, AN ARC LENGTH OF 87.36 FEET, (CHORD OF SAID CURVE BEARS: N67°45'52"W,  87.25 FEET); THENCE ON A CURVE TO THE LEFT WITH A RADIUS OF 500.00 FEET, AN ARC LENGTH OF 252.68 FEET, (CHORD OF SAID CURVE BEARS: N77°14'11"W,  250.00 FEET); THENCE S88°17'09"W, 400.00 FEET; THENCE ALONG THE WEST LINE OF SECTION 10 N01°33'59"W, 586.76 FEET TO THE POINT OF BEGINNING, CONTAINING 9.99 ACRES ALL IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.

 

is hereby changed from RSO (Single-Dwelling Residential) District to CN2 (Neighborhood Commercial) District, as such district is defined and prescribed in Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto.

 

SECTION 2. The rezoning granted in Section 1, supra, in addition to being subject to the general conditions established in Chapter 20 of the Code of the City of Lawrence, Kansas, 2015 Edition, as amended, is also subject to the following special conditions:

 

(a)        The City Commission shall review and approve any site plan application prior to issuance of a building permit on the subject property.

 

(b)        As part of any proposed development, the extraordinary buffer yard along Inverness Drive shall be limited to open space, landscaping, and park-type amenities.

 

(c)        The following uses shall be prohibited:

 

(i)         All uses identified within the Residential Use Group (including Household Living and Group Living) as set forth at City of Lawrence, Kan., § 20-403 (July 1, 2015), as amended.

 

(d)        Notice to property owners, which is required for any future site plan, shall extend one thousand feet (1000 ft.) from the property line of the subject property.

 

SECTION 3. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (January 1, 2015), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 4. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 5.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
