Vacation of existing access restrictions associated with Minor Subdivision, MS-15-00257, for O’Reilly-South Addition, located at 1008 W. 23rd Street.

 

Background

Minor Subdivisions/Replats are land divisions that are reviewed and processed administratively. These items are placed on the City Commission agenda when easements or rights-of-way are being dedicated or vacated.  A Minor Subdivision for O’Reilly-South Addition, MS-15-00257, was administratively approved by the Planning Director on June 15, 2015, pending the City Commission’s acceptance of vacation of exiting access restrictions to align with current improvements. The Minor Subdivision is attached with this memo for context; however, no action is necessary for the Minor Subdivision.

 

The final plat for the O’Reilly – South Addition was approved by the City Commission on March 30, 1999. The recorded plat contains a 36’ wide area shown as “Access Allowed” and two areas shown as “No Access Allowed”.  The access restrictions and permitted access of the final plat do not align with the physical improvements on the property.

 

This property was part of the 23rd Street Corridor project to replace two existing access points with one access point. The associated site plan was administratively approved on July 18, 2008 (SP-04-25-2008). The consolidated access point is located in an area shown as “No Access Allowed” on the final plat.

 

The Minor Subdivision corrects the inconsistencies of the recorded final plat by vacating the access restriction located at the existing access point, and establishing an access restriction that was shown as “Access Allowed” on the final plat.

 

Action

Accept the vacation of existing access restrictions to align with current improvements as shown on the Minor Subdivision, MS-15-00257, for O’Reilly-South Addition.
