RE:	Ordinance Repealing Recoupment Fees

Please place Ordinance No. 9088 on the City Commission’s agenda for consideration and approval.  It repeals Section 12-105.1 of the Code of the City of Lawrence, Kansas, 2015 Edition, as amended, relating to recoupment fees.   

Background

At its regular meeting on February 17, 2015, the City Commission directed city staff to prepare an ordinance eliminating recoupment fees from fees that can be assessed in Municipal Court.  Ordinance No. 9088 achieves the Commission’s direction. 

The Ordinance is effective upon its publication.  It is the Municipal Court’s intention to refund any recoupment fees paid from January 1, 2015, to the present.  Any fees assessed from January 1, 2015, to the present, but not yet paid, will be forgiven by the Court, and/or applied to any outstanding fine amounts owed by the Defendant.

Action

Adopt Ordinance No. 9088 on first reading.
