Hill Family Investments, LLC, Right of Way Agreement

 

Hill Family Investments, LLC, owns that real property commonly known as 512 E. 9th Street, Lawrence, Douglas County, Kansas.  Hill Family Investments, LLC, wishes to use the property -- and the property is properly zoned -- for an Events Center, hosting meetings, receptions, weddings, and the like. Hill Family Investments, LLC, has submitted to the City a Site Plan outlining its proposed use. Currently, there are four (4) parking spaces directly in front of the building that have been used as parking for the property for a number of years that are located in the City Right of Way. As a condition of approval of the Site Plan and in order to protect the City's rights in the Ninth Street Right of Way, the City will require Hill Family Investments, LLC, to execute a License Agreement, whereby it will be granted, subject to certain conditions, the nonexclusive right -- at no charge -- to use the Ninth Street Right of Way for those four (4) parking spaces.  City Staff and Hill Family Investments, LLC, have reached an agreement on the terms of a License Agreement.

 

Action Requested:

Staff requests the City Commission to authorize the City Manager to execute a License Agreement permitting Hill Family Investments, LLC, to use a portion of the Ninth Street Right of Way for four parking spaces in accordance with the terms of that Agreement.
