RESOLUTION NO. 7096

 

A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, THAT, IN THE EVENT THE QUALIFIED ELECTORS OF THE CITY OF LAWRENCE, KANSAS, APPROVE THE SALES TAX REFERENDUM FOR THE CONSTRUCTION AND EQUIPPING OF A NEW POLICE FACILITY, IT WILL, IN ORDER TO OFF-SET ALL OR A PORTION OF THE COST OF THE PURCHASE OF THE REAL PROPERTY UPON WHICH THE POLICE FACILITY WILL BE LOCATED, SELL SURPLUS REAL PROPERTY WITHIN ITS INVENTORY.

 

 

WHEREAS, on August 12, 2014, the Governing Body adopted and approved City of Lawrence, Kan., Resolution No. 7083 (Aug. 12, 2014), wherein it resolved to call a special question election submitting to the qualified electors of the City the proposition of a special sales tax referendum, in the amount of two-tenths of one percent (0.20) for a period of nine years or less, to pay the cost of financing, constructing, and equipping a new police facility and related parking and infrastructure improvements therefor;

 

WHEREAS, the City has entered into a letter of intent with Hallmark Cards, Incorporated, the owner of the real property upon which the City intends to locate its new police facility ("the Hallmark property"), whereby, if among other conditions, the qualified electors of the City approve the proposed sales tax referendum for the financing, constructing, and equipping a new police facility, then the City will purchase the Hallmark property; and

 

WHEREAS, in order to off-set some or all of the purchase price of the Hallmark property, the Governing Body wishes to sell surplus real property within the City's inventory, including the existing Investigations and Training Center (ITC), surplus acres of the Hallmark property, receive funds from Douglas County for the vacation of police department uses at the Judicial Law Enforcement building, and possibly other sites owned by the City.

 

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. In the event that the qualified electors of the City of Lawrence, Kansas, approve the proposed special sales tax referendum to be held on November 4, 2014, to pay the costs of financing, constructing, and equipping a new police facility, the Governing Body intends, at its discretion, to off-set some or all of the costs of purchasing the Hallmark property through the sale of surplus real property within its inventory, including the existing Investigations and Training Center (ITC), surplus acres on the Hallmark property that is determined by the City not to be necessary for the police facility, funds from Douglas County for the vacation of police department uses at the Judicial Law Enforcement building,  and possibly other sites.
