RE:

Romero Agreement

In order to construct the Wakarusa Wastewater Treatment Plant, the City must purchase from Virginia L. Romero, three easements over her property: (1) waterline and drainage easement; (2) temporary construction easement; and (3) a utility easement. The City must also purchase a portion of her property, as right of way, for the purpose of widening East 1600 Road, which will serve the Wakarusa Wastewater Treatment Plant.

Ms. Romero has agreed to sell said easements and the right of way to the City for the sum of $23,795.09 and the City's agreement to relocate and reconstruct a fence, fill some property, and to relocate certain large rocks. The parties have reached an agreement as to the language to be used in the agreement, the easements, and the right of way dedication.

Action Requested:

Staff requests the City Commission to authorize the City Manager to execute an Agreement with Virginia L. Romero, whereby the City will, for the sum of $23,795.09 and in accordance with the terms of that agreement, purchase from Ms. Romero three easements and property for right of way, all needed by the City to construct the Wakarusa Wastewater Treatment Plant.
