Agenda Item – Authorize the City Manager to execute Supplemental Agreement No.3 for continued Construction Phase Engineering Services for Project UT0701DS Kaw Water Treatment Plant Transmission Main.

 

Background

The 2003 Water Master Plan identified projects to address the required increase in  capacity and the addition of redundant facilities related to the transmission of finished drinking water from the Kaw Water Treatment Plant (WTP) to the southeast Lawrence area and a second watermain crossing of the Kansas River to North Lawrence.

 

The Integrated 2012 Water Utilities Plan maintained the recommended project with the completion of a modified Phase I from the Kaw WTP to North 3rd Street in 2013 – 2014 to provide a redundant water supply connection to North Lawrence. The Plan recommended the completion of Phase II in 2019, and Phase III by 2025 to address capacity requirements in Southeast Lawrence. Phase I Map attached.

 

Project Status

On January 7, 2014, the City Commission awarded the construction contract to Garney Companies, Inc., and authorized the execution of Supplemental Agreement No.2 with Burns & McDonnell for Construction Phase Engineering Services.

 

As originally negotiated, the Supplemental Agreement for Construction Phase Services with Burns & McDonnell anticipated providing part-time construction observation for construction duration of 240 calendar days. Garney Construction was provided Notice to Proceed as of January 29, 2014 setting Final Completion of the project on September 26, 2014. Garney’s currently proposed schedule indicates a completion in mid-October. Staff has negotiated a Supplemental Agreement No.3 with Burns & McDonnell in the amount of $40,000 for additional Construction Phase Engineering Services to cover the extended construction period.

 

On September 8, 2014, Garney was notified of the pending assessment of Liquidated Damages at a rate of $1,000/day due to the late completion of the project. Pending any approved claim for additional contract times, the assessment of these damages will offset the additional Construction Phase Engineering Services associated with the extended construction period.

 

Project Funding

The construction is funded from the Department of Utilities 2013 Capital Improvements and Rate Program Bonded Construction Fund Resolution 7019.

 

Action

Authorize the City Manager to execute Supplemental Agreement No.3 to the existing Engineering Services Agreement with Burns & McDonnell in the amount of $40,000 for continued construction phase engineering services in conjunction with project UT0701DS Kaw Water Treatment Plant Transmission Main Phase I.
