ORDINANCE NO. 9035

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING THE CITY'S SCHEDULE OF NO PARKING ZONES IN ACCORDANCE WITH CHAPTER 17, ARTICLE 4 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION, AND AMENDMENTS THERETO.

WHEREAS, as a result of redevelopment of the northeast corner of the intersection of Ninth Street and New Hampshire Street, The Lawrence Bank is temporarily relocating -- during the period of construction -- its Downtown Lawrence Bank to 800 Massachusetts Street;

WHEREAS, in order to relocate and serve its patrons, The Lawrence Bank has asked to lease two parking spaces and to install a canopy overhanging those two parking spaces in the City's Eighth Street Right of Way;

WHEREAS, The Lawrence Bank also requests that the parking spaces be reserved for patrons of The Lawrence Bank during its drive-through business hours, which are 8:00 o'clock a.m. through 6:00 o'clock p.m. Mondays through Fridays, and 9:00 o'clock a.m. through 12:00 o'clock p.m. on Saturdays;

WHEREAS, those parking spaces would be open and available to the general public for use outside those hours; and

WHEREAS, the City wishes to accommodate both the redevelopment project located at the northeast corner of the intersection of Ninth Street and New Hampshire Street and the temporary relocation of The Lawrence Bank.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION 1. The above-stated recitals are incorporated herein by reference and shall be as effective as if repeated verbatim.

SECTION 2. From and after the effective date of this Ordinance and the installation of proper traffic control devices, parking on the two spaces on Eighth Street, as shown on Exhibit A to this Ordinance, shall be reserved for patrons of The Lawrence Bank, from 8:00 o'clock a.m. through 6:00 o'clock p.m. Mondays through Fridays, and from 9:00 o'clock a.m. through 12:00 o'clock p.m. on Saturdays. At all other times and hours, those parking spaces shall be open and available for use by the general public.

SECTION 3. The City Engineer is hereby directed to amend the Schedule of No Parking maintained in the Office of the City Engineer to reflect the provisions of Section 2, supra.

SECTION 4. This Ordinance shall be in effect only so long as The Lawrence Bank occupies the premises at 800 Massachusetts Street. Upon the relocation of The Lawrence Bank from 800 Massachusetts Street, this Ordinance shall terminate by its own terms, and the City Engineer shall amend the Schedule of No Parking by removing the provisions of this Ordinance therefrom.

SECTION 5. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

SECTION 6.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
