RE:

Rezoning ordinance 9034 for the office portion of the Bauer Farm Planned Development (Z-3-16-05). Approximately 2.29 acres located in the northwest corner of the intersection of W 6th Street and Folks Road.

 

Background

The rezoning request, Z-3-16-05, to rezone the southeast portion of the Bauer Farm Development (Figure 1) from PRD-2 (Planned Residential Development to the POD-1 (Planned Office Development) was approved by the City Commission at their January 10, 2006 meeting subject to the following conditions:

  1. Approval of a Preliminary Development Plan; including approval of a downstream wastewater analysis per Section 21-706(d).
  2. Filing of a Final Plat for the property at the Register of Deeds Office.
  3. No building permit will be issued until the W. 6th Street Project is substantially completed.

 

A Preliminary Development Plan has been approved for the Bauer Farm Residential Development and the W. 6th Street Project has been completed. The City Commission voted at their May 20, 2014 meeting (see attached staff memo) to remove the remaining condition requiring the property to be platted before publication of the rezoning ordinance and directed staff to prepare the rezoning ordinance.

 

The POD-1 District is a non-residential district which allows uses listed in Section 20-1004(d) of the pre-2006 Zoning Ordinance. The POD zoning is conditioned to reflect that the uses permitted in this district are the uses permitted in the POD-1 District as defined in the 1966 Zoning Ordinance.

 

Action

Adopt the rezoning ordinance, Ordinance No. 9034, on first reading, for rezoning of the southeast portion of the Bauer Farm Development to the Planned Office Development, POD [Bauer Farm].
