RESOLUTION NO. 7078

 

A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, AMENDING SECTION 2 OF RESOLUTION NO. 7038 AND ORDERING THE IMPROVEMENT AND AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR CERTAIN MAIN TRAFFICWAY IMPROVEMENTS WITHIN THE CITY OF LAWRENCE, KANSAS.

           

WHEREAS, on August 13, 2013, the City of Lawrence, Kansas (the “City”) adopted Resolution No. 7038 authorizing certain fiber optic cable improvements along 6th Street from Iowa to Wakarusa Drive (the “Improvements”) pursuant to K.S.A. 12-685 et seq.; and

 

            WHEREAS, the City desires to amend Resolution No. 7038 to expand the scope of the Improvements; and

 

            WHEREAS, the Governing Body has previously designated the following streets or main trafficways within the City of Lawrence:

 

6th Street, within the City limits;

Wakarusa Drive, from 6th Street to Clinton Parkway;

Clinton Parkway, within the corporate limits of the City, and

23rd Street, within the corporate limits of the City.

 

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

            SECTION 1.  Section 2 of Resolution No. 7038 is hereby amended as follows:

 

Section 2.  The Governing Body hereby authorized the construction of fiber optic cable improvements as follows:

 

Improvements along 6th Street from Iowa to K-10 Highway, Wakarusa Drive from 6th Street to Clinton Parkway, Clinton Parkway from Wakarusa Drive to Iowa Street, at the intersection of 23rd & O’Connell, along 6th Street from Iowa to Wakarusa Drive, including but not limited to fiber optic cable and installation, conduit and installation of conduit, associated traffic control devices related to intelligent transportation systems and related equipment, and other fiber optic cable improvements necessary to proceed with completing the City’s redundant fiber optic system ring within Lawrence, and any related design, engineering and inspection work

 

and authorizes the issuance of general obligation bonds pursuant to K.S.A. 12-685 et seq. to pay the costs thereof.

 

            SECTION 2.  The City expects to design, construct and to make additional capital expenditures on and after the date of adoption of this resolution in connection with the improvements set forth in this resolution, and the City intends to reimburse itself for such expenditures with the proceeds of the bonds and/or notes in the maximum principal amount of $400,000 plus costs of issuance and interest on any temporary financing.

 

            SECTION 3.   This Resolution shall be effective from and after adoption by the Governing Body.

 

            ADOPTED by the governing body of the City of Lawrence, Kansas, on July 22, 2014.
