ORDINANCE NO. 8994

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ANNEXING APPROXIMATELY 54.31 ACRES, GENERALLY LOCATED IN DOUGLAS COUNTY, KANSAS, SURROUNDING THE PROPOSED K-10 HIGHWAY & BOB BILLINGS PARKWAY INTERCHANGE, INTO THE CITY OF LAWRENCE, KANSAS, PURSUANT TO K.S.A. 2013 SUPP. 12-520(a)(7).

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The Governing Body finds that the annexation of that certain real property, generally located in Douglas County, Kansas, surrounding the proposed K-10 Highway & Bob Billings Parkway interchange, the legal description of which is set forth at Section 2, infra, is in the public interest, that all conditions precedent to annexation have occurred, and that annexation is proper under K.S.A. 2013 Supp. 12-520(a)(7).

 

SECTION 2. In accordance with the Governing Body's findings, the City hereby annexes into the City that real property bearing the following legal description, to-wit:

 

A tract of land lying in the following Quarter Section; Southeast Quarter of Section 31, and the Southwest Quarter of Section 32, all situated in Township 12 South, Range 19 East of the 6th P.M., described as follows: 

 

BEGINNING at the Southeast corner of said Southeast Quarter of Section 31; FIRST COURSE, thence on an assumed bearing of South 88 degrees 09 minutes 11 seconds West, 388.74 feet along the South line of said Section 31; SECOND COURSE, thence North 00 degrees 32 minutes 24 seconds West, 503.72 feet; THIRD COURSE, thence North 15 degrees 07 minutes 24 seconds West, 452.90 feet; FOURTH COURSE, thence North 01 degree 49 minutes 35 seconds West, 222.52 feet; FIFTH COURSE, thence North 29 degrees 02 minutes 01 second East, 698.90 feet; SIXTH COURSE, thence North 22 degrees 56 minutes 29 seconds East, 166.40 feet; SEVENTH COURSE, thence North 02 degrees 40 minutes 28 seconds West, 731.94 feet to the North line of said Southeast Quarter of Section 31; EIGHTH COURSE, thence North 87 degrees 32 minutes 13 seconds East, 25.00 feet along said North line to the Northwest corner of said Southwest Quarter of Section 32; NINTH COURSE, thence North 87 degrees 56 minutes 45 seconds East, 427.57 feet along the North line of said Southwest Quarter of Section 32; TENTH COURSE, thence South 02 degrees 42 minutes 30 seconds East, 586.95 feet; ELEVENTH COURSE, thence South 17 degrees 13 minutes 52 seconds East, 823.49 feet; TWELFTH COURSE, thence North 88 degrees 02 minutes 10 seconds East, 350.00 feet; THIRTEENTH COURSE, thence South 48 degrees 25 minutes 57 seconds East, 275.86 feet; FOURTEENTH COURSE, thence North 88 degrees 02 minutes 10 seconds East, 146.66 feet; FIFTEENTH COURSE, thence South 02 degrees 35 minutes 18 seconds East, 85.47 feet to the center line of a public road; SIXTEENTH COURSE, thence North 87 degrees 41 minutes 43 seconds East, 77.39 feet along said center line; SEVENTEENTH COURSE, thence South 01 degree 56 minutes 22 seconds East, 95.00 feet; EIGHTEENTH COURSE, thence South 88 degrees 02 minutes 10 seconds West, 174.94 feet; NINETEENTH COURSE, thence South 69 degrees 01 minute 49 seconds West, 475.95 feet; TWENTIETH COURSE, thence South 28 degrees 50 minutes 41 seconds West, 586.94 feet; TWENTY-FIRST COURSE, thence South 43 degrees 48 minutes 18 seconds West, 133.57 feet; TWENTY-SECOND COURSE, thence South 24 degrees 18 minutes 51 seconds West, 93.20 feet; TWENTY-THIRD COURSE, thence South 72 degrees 11 minutes 54 seconds East, 91.01 feet; TWENTY-FOURTH COURSE, thence South 01 degree 55 minutes 32 seconds East, 33.00 feet to the South line of said Southwest Quarter of Section 32; TWENTY-FIFTH COURSE, thence South 88 degrees 04 minutes 28 seconds West, 417.20 feet along said South line to the POINT OF BEGINNING.  The above described tract contains 54.31 acres, more or less.

 

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
