ORDINANCE NO. 8702

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 15.86 ACRES FROM BAUER FARM PRD-2 (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT TO PRD [BAUER FARM] (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION, AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

LOT 1, A FINAL PLAT OF BAUER FARM FOURTH PLAT, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, ACCORDING TO THE PLAT THEREOF AS FILED IN PLAT BOOK 18 AT PAGE 440 IN THE OFFICE OF THE REGISTER OF DEEDS OF SAID COUNTY AND STATE, LESS THAT PART THAT LIES WITHIN PUBLIC ROADS ;

 

TOGETHER WITH A TRACT OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 28, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

BEGINNING AT A POINT WHICH BEARS SOUTH 88°11′38″ WEST, 273.91 FEET ALONG THE SOUTH LINE OF SAID SOUTHEAST QUARTER AND NORTH 01°48′22″ WEST, 75.00 FEET FROM THE SOUTHEAST CORNER OF SAID SOUTHEAST QUARTER, SAID POINT BEING ON THE NORTH RIGHT-OF-WAY LINE OF UNITED STATES HIGHWAY 40, ALSO KNOWN AS SIXTH STREET; THENCE SOUTH 88°11′38″ WEST, ALONG SAID NORTH RIGHT-OF-WAY LINE, 766.89 FEET; THENCE NORTH 01°48′22″ WEST, DEPARTING SAID NORTH RIGHT-OF-WAY LINE, 287.00 FEET TO A POINT ON THE NORTH RIGHT-OF-WAY OF BAUER FARM DRIVE; THENCE SOUTH 88°11′38″ WEST, ALONG SAID NORTH RIGHT-OF-WAY LINE, 112.00 FEET;

THENCE NORTH 01°48′22″ WEST, 473.00 FEET TO A POINT ON THE SOUTH RIGHT-OF-WAY LINE OF OVERLAND DRIVE; THENCE NORTH 88°11′38″ EAST, ALONG SAID SOUTH RIGHT-OF-WAY LINE, 636.06 FEET TO THE NORTHWEST CORNER OF LOT 1, BAUER FARM FOURTH PLAT; THENCE SOUTH 01°48′22″ EAST, ALONG THE WEST LINE OF SAID LOT 1, 533.00 FEET TO A POINT ON THE SOUTH RIGHT-OF-WAY LINE OF BAUER FARM DRIVE; THENCE NORTH 88°11′38″ EAST, ALONG SAID SOUTH RIGHT-OF-WAY LINE, 242.88 FEET; THENCE SOUTH 01°48′22″ EAST, DEPARTING SAID SOUTH RIGHT-OF-WAY LINE, 227.00 FEET TO THE POINT OF BEGINNING. CONTAINS 15.86 ACRES, MORE OR LESS.

 

 

is hereby changed from Bauer Farm PRD-2 (Planned Residential Development) District to PRD [Bauer Farm] (Planned Residential Development) District, as such district is defined and prescribed in Chapter 20 of the Code of the City of Lawrence, Kansas, 2013 Edition, and amendments thereto.

 

SECTION 2. The rezoning granted in Section 1, supra, in addition to being subject to the general conditions established in Chapter 20 of the Code of the City of Lawrence, Kansas, 2013 Edition, as amended, is also subject to the following special condition:

 

         The maximum permitted residential density shall not exceed 25 dwelling units per net residential acre

 

SECTION 3. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (July 1, 2013), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 4 If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 5.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
