Background
The Lutheran Association of Ministries and Pilots U.S., Inc., a Wisconsin not-for-profit corporation ("Haskell Light"), is constructing a church and campus center on the campus of Haskell Indian Nations University. To comply with the Americans with Disabilities Act of 1990 (ADA), Haskell Light is required to provide a minimum of two handicap accessible parking spaces (ADA parking spaces). In its Site Plan, Haskell Light proposes to install two ADA parking spaces within a portion of the Pawnee Avenue Right of Way. Approval of the proposed Site Plan is subject to several conditions, including the execution of a License Agreement that would permit Haskell Light to use a portion of the Pawnee Avenue Right of Way for two ADA parking spaces. City Staff and Haskell Light have reached an agreement on the language to be used in the License Agreement. Haskell Light would execute it, and upon the signature of the City Manager it would become final.
Action Requested
Staff requests the City Commission to authorize the City Manager to execute a License Agreement permitting the Lutheran Association of Ministries and Pilots U.S., Inc., to use certain portions of the Pawnee Avenue Right of Way in accordance with the terms of that Agreement.
