RE:	Annexation request for approximately 54.31 acres located at the future K-10 & Bob Billings Parkway interchange

The city, with the consent of the Kansas Department of Transportation, desires to annex approximately 54.31 acres surrounding the future K-10 & Bob Billings Parkway interchange.  The City and County are participating in the cost of construction with KDOT for this interchange improvement.  The City will be financing its share through the issuance of bonds.  To issue bonds, the property and improvements must be located within the city limits. 

Since the land proposed to be annexed is owned by the State of Kansas, and adjoins the city, it may be unilaterally annexed by the city pursuant to K.S.A. 12-520(a)(3).  Notice will be sent to the applicable utility providers. The area is served by Atmos Energy and Rural Water District #1.

Per City policy, the request will need to be reviewed by the Planning Commission because the land proposed to be annexed is larger than ten (10) acres.   

Requested Action:

Refer the request to the Planning Commission for review and authorize the City Manager to notify Atmos Energy and RWD #1 of the City’s intent to annex the subject property.
