Authorize the Mayor to Execute Supplemental No. 1 to the City State Agreement No. 12-12 with Kansas Department of Transportation addressing Utilities and Public Works items related to the construction of the South Lawrence Trafficway and 31st Street.

Project Background - Utilities

The South Lawrence Trafficway (SLT) is currently under construction by Emery Sapp & Sons, the general contractor for the Kansas Department of Transportation (KDOT). Required watermain and sanitary sewer relocations in the area of 31st and Haskell were designed and bid as part of the KDOT SLT project due to the required construction sequencing in this area. The construction of these relocations will be paid for by the Department of Utilities.

 

Per KDOT’s direction, the design and proposed construction of additional sanitary sewer relocations and the extension of a watermain in the area of 31st and Louisiana were put forth as projects to be bid and constructed by the City of Lawrence separately from the SLT project. Approximately 4,000 linear feet of 12” diameter watermain, and 5,100 linear feet of sanitary sewer will be constructed in this area (see attached map).

 

The Department of Utilities contracted with HNTB, the design firm for the SLT project, for design of the required sanitary sewer and watermain relocations in this area. HNTB have completed the plans and specifications, and City staff has acquired the necessary easements.

 

Project Status - Utilities

Construction in the area of 31st and Louisiana has become a complicated scheduling and construction sequencing issue due to the ongoing relocation of Southern Star Petroleum’s 16” diameter pipeline and a Black Hills Energy natural gas main. These pipelines conflict with both the SLT project and the new location of the City of Lawrence sanitary sewers and watermain. At this time, neither utility has a firm timeline for the relocation of their existing pipelines. As a result, the City cannot include construction schedule information within its project bid documents to meet the mandated KDOT relocation dates and avoid delays to the SLT project. Delays in the relocation of utilities in conflict with the SLT construction which ultimately delay Emery Sapp & Sons work on the SLT will result in significant penalties assessed by KDOT.

 

The City Commission approved the negotiation of a City – State Agreement with KDOT on January 7, 2014.  Staff negotiated a Supplement to the current City – State Agreement with KDOT, including payment to KDOT for the construction of the required sanitary sewer and watermain relocations in the area of 31st and Louisiana in the negotiated amount of $2,001,542. The improvements will be constructed by KDOT’s SLT contractor Emery Sapp and Sons under a change order to their SLT contract with KDOT. All costs associated with these relocations are being paid by the Department of Utilities.

 

Project Status – Public Works

In May 2012, the City entered into an agreement with the Secretary of Transportation to include the construction of 31st Street with the South Lawrence Trafficway Project.  Within that agreement KDOT also acquired the right-of-way needed for 31st Street to be reimbursed by the City. 

 

In review of the 31st Street project, the Corps identified approximately 11 acres of wetlands that the City needed to mitigate.  KDOT verbally agreed to allow the City to use excess property that they acquired for the SLT mitigation plan that would enhance the Baker Wetland Project.  The approximate cost was $6,500/acre.  The City has also entered into an agreement with Baker University to accept this property and construct, manage and maintain the wetland for the City of Lawrence.

 

The Supplemental Agreement reiterates the agreement for property acquisition for the construction of 31st Street and also formally consummates the agreement for the wetland mitigation property between the City and KDOT.
