Star Right of Way Agreement |

As the result of the South Lawrence
Trafficway, Southern Star, which delivers natural gas to retailers in the area,
must relocate portions of its pipeline. To complete that relocation, Southern
Star wishes to cross under the City's rights of way at South Ousdahl Road and
South Michigan Street in the vicinity of 33rd Street. Because the relocation is
necessitated by the completion of the South Lawrence Trafficway and because the
completion of that highway will greatly benefit the City, it is KDOT's
recommendation as well as City Staff's that said use of the City's rights of
way be permitted as an accommodation to Southern Star without requiring the
payment of any fee or rent. Southern Star has agreed to install its pipelines
in certain locations and at certain depths, to move its pipelines at its cost
if such becomes necessary during the completion or improvement of either
Ousdahl or Michigan Street, and to execute a Right of Way License Agreement
governing its use of the City's rights of way. City Staff prepared the License
Agreement and approves it.
Action
Requested: Staff
requests the City Commission to authorize the City Manager to execute a License
Agreement with Southern Star Central Gas Pipeline, Inc., allowing it to use the
City Rights of Way at South Ousdahl Road and South Michigan Street in the vicinity
of 33rd Street for the placement of its pipeline for the transmission of
natural gas, all in accordance with the terms of that License Agreement, if
appropriate.
