RESOLUTION NO. 7055

 

A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, APPROVING CONDITIONALLY AN APPLICATION FOR LOW INCOME HOUSING TAX CREDITS FROM THE STATE OF KANSAS FOR "BETHEL ESTATES OF LAWRENCE," A PROPOSED HOUSING DEVELOPMENT THAT IS CURRENTLY ADDRESSED AT 2101 EXCHANGE COURT, BUT SUBJECT TO CHANGE WITH DEVELOPMENT.

 

WHEREAS, Wheatland Investments, LLC, having a principal place of business at Olathe, Kansas, has informed the City of Lawrence, Kansas, that it will be filing a low income housing tax credit application with the Kansas Housing Resource Corporation for the proposed development of "Bethel Estates of Lawrence," which shall include affordable senior rental housing, on that real property now commonly known as 2101 Exchange Court, but which address may change subject to development, and bearing the following legal description, to-wit:

 

Lot 3, Block 1, in a Final Plat of Fairfield Farms West Addition in the City of Lawrence, Douglas County, Kansas.

 

WHEREAS, the proposed housing development will contain 90 dwelling units that will be constructed in phases;

 

WHEREAS, the proposed housing development’s dwelling units will be marketed to tenants, who are older, ambulatory adults, aged 55 years and older, and will be operated as independent living facilities; and

 

WHEREAS, the proposed housing development will consist of one and two bedroom dwelling units, containing, among other things, the following amenities: washers/dryers and upgraded appliances, an on-site leasing office, and a community center.

 

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1: The above-stated recitals are incorporated herein by reference as if set forth in full.

 

SECTION 2: The Governing Body of the City of Lawrence, Kansas, approves the application of Wheatland Investments, LLC, having its principal place of business at Olathe, Kansas, for low income housing tax credits from the Kansas Housing Resource Corporation for a proposed low income housing development, "Bethel Estates of Lawrence," on that real property now commonly known as 2101 Exchange Court, but which address may change subject to development, the legal description of which is set forth in the recitals, supra, subject to the following two conditions: (a) the housing development includes, at a minimum, all commitments, appointments,  and amenities, as set forth in the recitals; and (b) the developer obtains all necessary land use, site plan, and building code approvals for the proposed housing development from the City of Lawrence, Kansas, Department of Planning and Development Services.

 

SECTION 3: This Resolution shall be and remain effective until July 30, 2014. In the event that any of the described characteristics of the proposed housing development, as set forth in the recitals, supra, shall change prior to the issuance of a building permit, then this Resolution shall be deemed null and void.
