ORDINANCE NO. 8951

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING CHAPTER I, ARTICLE 2, SECTION 201, OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION, AND AMENDMENTS THERETO, PERTAINING TO THE SALARY OF CITY COMMISSIONERS AND THE MAYOR OF THE CITY OF LAWRENCE, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION 1: Existing Chapter 1, Article 2, Section 1-201 of the Code of the City of Lawrence, Kansas, 2013 Edition, and amendments thereto, is hereby repealed in its entirety, it being the intent of the Governing Body that Section 2 of this Ordinance supersede it.

SECTION 2:  Chapter 1, Article 2, Section 1-201 of the Code of the City of Lawrence, Kansas, 2013 Edition, and amendments thereto, is hereby amended to read as follows:

1-201                GOVERNING BODY; VACANCIES; SALARIES.

(a)   The Governing Body of the City of Lawrence shall consist of five (5) Commissioners. Terms of the Commissioners shall be as provided by law.  Vacancies on the Commission shall be filled by the election of a successor by a majority vote of the remaining Commissioners, except that in the case of a tie vote, the City Attorney shall cast the deciding vote.  No distinction shall be made in the titles and duties among the Commissioners except as the Commission shall organize itself for business.

(b)   As provided by Charter Ordinance No. 15, the salary of City Commissioners shall be established by ordinary ordinance.  Commissioners who are elected and sworn into office after March 31, 2015, shall receive an annual salary of $15,000.00 and the commissioner serving as Mayor shall receive an annual salary of $18,000, except that Commissioners duly seated in their position at the time of enactment of Ordinance No. 8951 shall not be eligible for any increase in annual salary herein provided until he has been reelected by the qualified voters of the City in a regular City Commission electionCommissioners seated at the time of enactment of Ordinance No. 8951 shall receive an annual salary of $9,000 and those serving as mayor shall receive an annual salary of $10,000 until the end of the commissioners’ current terms. 

(c)   The salaries of the Commissioners and Mayor shall be reviewed in January 2018, and in January every two years thereafter.

 

SECTION 3: If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

SECTION 4: This ordinance shall take effect and be in force after its passage and publication as provided by law.
