Property Acquisition: 1106 Rhode Island Street

 

 

Pursuant to City Commission direction and adoption of Resolution 7013 and Ordinance 8856, the City Attorney’s Office has been working to acquire by eminent domain, the real property located at 1106 Rhode Island Street.

 

The Appraisers panel appointed by the District Court held their hearing on December 20, 2013 and filed their report.  They have awarded just compensation in the amount of $114,500 to the property owner.  Staff recommends payment of the award.  Pursuant to K.S.A. 26-507, upon payment of the award to the Clerk of the District Court, title to the property shall vest with the City.  Either party may appeal the award by initiating a new action in Douglas County District Court.  City Attorney’s staff does not recommend appealing the award which would involve a jury trial.

 

Upon transfer of ownership of the subject property Planning and Development Services Department staff will draft a Request for Proposals (RFP) for City Commission consideration to accept bids to rehabilitate the property.

 

Action Requested:

Authorize payment to the Clerk of the Douglas County District Court in the amount of $114,500 for property acquisition for 1106 Rhode Island Street.
