ORDINANCE NO. 8924

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ANNEXING APPROXIMATELY 8.68 ACRES, GENERALLY LOCATED IN DOUGLAS COUNTY, KANSAS, AT THE NORTHWEST CORNER OF 31ST STREET AND LOUISIANA STREET, INTO THE CITY OF LAWRENCE, KANSAS, PURSUANT TO K.S.A. 2012 SUPP. 12-520(a)(2).

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION 1. The Governing Body is the owner of record of that certain real property, generally located in Douglas County, Kansas, at the northwest corner of 31st Street and Louisiana Street, the legal description of which is set forth at Section 2, infra, and finds that annexation of said real property is in the public interest, that all conditions precedent to annexation have occurred, and that annexation is proper under K.S.A. 2012 Supp. 12-520(a)(2).

SECTION 2. In accordance with the Governing Body's findings, the City hereby annexes into the City that real property bearing the following legal description, to-wit:

DESCRIPTION FOR THE ANNEXATION OF A TRACT OF LAND IN THE SOUTHEAST QUARTER (SE ¼) OF SECTION 12, TOWNSHIP 13 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN IN DOUGLAS COUNTY, KANSAS DESCRIBED AS FOLLOWS:

BEGINNING AT THE SOUTHEAST CORNER OF THE SOUTHEAST QUARTER (SE ¼) OF SECTION 12, TOWNSHIP 13 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN IN DOUGLAS COUNTY, KANSAS; THENCE SOUTH 87°41’23” WEST ON THE SOUTH LINE OF THE SOUTHEAST QUARTER (SE ¼) OF SAID SECTION 12, A DISTANCE OF 460.00 FEET; THENCE NORTH 01°46’06” WEST, PARALLEL TO THE EAST LINE OF THE SOUTHEAST QUARTER (SE ¼) OF SAID SECTION 12, A DISTANCE OF 823.78 FEET, TO THE SOUTHWEST CORNER OF LOT 1, INDIAN HILLS CHURCH OF GOD, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE NORTH 88°13’54” EAST ON THE SOUTH LINE OF SAID LOT 1, A DISTANCE OF 420.00 FEET TO THE SOUTHEAST CORNER OF SAID LOT 1; THENCE CONTINUING NORTH 88°13’54” EAST A DISTANCE OF 40.00 FEET TO THE EAST LINE OF THE SOUTHEAST QUARTER (SE ¼) OF SAID SECTION 12; THENCE SOUTH 01°46’06” EAST ON THE EAST LINE OF THE SOUTHEAST QUARTER (SE ¼) OF SAID SECTION 12 A DISTANCE OF 819.43 FEET TO THE POINT OF BEGINNING, CONTAINING 8.68 ACRES MORE OR LESS ALL IN DOUGLAS COUNTY, KANSAS, SUBJECT TO RIGHTS-OF-WAY, EASEMENTS AND RESTRICTIONS OF RECORD.

SECTION 3. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

SECTION 4.   This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
