ORDINANCE NO. 8908

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REZONING APPROXIMATELY 16.62 ACRES FROM UR (URBAN RESERVE) DISTRICT, PCD (PLANNED COMMERCIAL DEVELOPMENT) DISTRICT, AND RS10 (SINGLE-DWELLING RESIDENTIAL) DISTRICT TO CN2 (NEIGHBORHOOD COMMERCIAL) DISTRICT AND AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION,” AND AMENDMENTS THERETO.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1. The base zoning district classification for the following legally described real property, situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A TRACT OF LAND IN THE SOUTHWEST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE 6TH PRINCIPAL MERIDIAN, IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

COMMENCING AT THE NORTHWEST CORNER OF SAID SOUTHWEST QUARTER; THENCE NORTH 87°56’47” EAST, ALONG THE NORTH LINE OF SAID SOUTHWEST QUARTER, 427.54 FEET TO A POINT ON THE EASTERLY RIGHT-OF-WAY OF THE SOUTH LAWRENCE TRAFFICWAY; THENCE ALONG SAID EASTERLY RIGHT-OF-WAY LINE SOUTH 02°42’20” EAST, 585.05 FEET; THENCE SOUTH 17°07’14” EAST, 84.72 FEET TO THE POINT OF BEGINNING; THENCE NORTH 88°01’18” EAST, 1060.10 FEET; THENCE SOUTH 01°58’42” EAST, 940.00 FEET; THENCE SOUTH 88°01’18’ WEST, 317.31 FEET; THENCE NORTH 01°58’42” WEST, 35.00 FEET; THENCE NORTH 48°03’58” WEST, 272.12 FEET; THENCE NORTH 41°56’02” EAST, 85.00 FEET; THENCE NORTH 48°03’58” WEST, 57.21 FEET; THENCE NORTH 01°58’42” WEST, 187.86 FEET; THENCE SOUTH 88°01’18” WEST, 165.77 FEET; THENCE SOUTH 01°58’42” EAST, 137.82 FEET; THENCE ON A CURVE TO THE RIGHT HAVING A RADIUS OF 55.00 FEET, A CHORD BEARING OF SOUTH 37°59’27” WEST, A CHORD LENGTH OF 70.66, AND AN ARC LENGTH OF 76.74 FEET; THENCE SOUTH 01°35’51” EAST, 90.91 FEET; THENCE SOUTH 88°24’09” WEST, 160.78 FEET; THENCE NORTH 17°07’14” WEST, 734.83 FEET TO THE POINT OF BEGINNING. CONTAINS 16.62 ACRES, MORE OR LESS.

 

is hereby changed from UR (Urban Reserve) District, PCD (Planned Commercial Development) District, and RS10 (Single-Dwelling Residential) District to CN2 (Neighborhood Commercial) District, as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2013 Edition,” and amendments thereto.

 

 

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (July 1, 2013), is hereby amended by showing and reflecting thereon the new zoning district classification for the subject property as described in more detail in Section 1, supra.

 

SECTION 3. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 4.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
