ORDINANCE NO. 8899

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING CHAPTER III, ARTICLE 2, CODE OF THE CITY OF LAWRENCE, KANSAS, 2013 EDITION, AND AMENDMENTS THERETO, BY AMENDING SECTION 3-209 AND ADDING SECTION 3-210 PERTAINING TO THE REGULATION OF ANIMALS.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1: The Code of the City of Lawrence, Kansas, 2013 Edition, is hereby amended by repealing Chapter III, Article 2, Section 3-209 which reads as follows:

 

3-209               PENALTY FOR VIOLATION OF CHAPTER.

Any person convicted of the violation of any of the provisions of this Chapter shall upon conviction thereof be fined not less than $10.00 nor more than $500.00, and that upon any second or subsequent violation shall be fined not less than $10.00 nor more than $500.00 and or imprisoned for not more than ten (10) days. Each consecutive day's violation shall constitute a separate punishable offense. (1990 Code 3-107, 3-210; Ord. 6389)

 

SECTION 2: The Code of the City of Lawrence, Kansas, 2013 Edition, is hereby amended by adding Chapter III, Article 2, Section 3-209 which reads as follows:

 

3-209               DOGS IN CEMETERIES.

It shall be unlawful for any dog owner to permit his or her dog, unless it is a service dog, to enter a city cemetery if the dog is not firmly attached to a leash or chain and under the physical control of its owner. Dogs that enter the cemetery must stay on the cemetery road.

 

 

SECTION 3: The Code of the City of Lawrence, Kansas, 2013 Edition, is hereby amended by adding Chapter III, Article 2, Section 3-210 which reads as follows:

 

 

3-210               PENALTY FOR VIOLATION OF CHAPTER.

Any person convicted of the violation of any of the provisions of this Chapter shall upon conviction thereof be fined not less than $10.00 nor more than $500.00, and that upon any second or subsequent violation shall be fined not less than $10.00 nor more than $500.00 and or imprisoned for not more than ten (10) days. Each consecutive day's violation shall constitute a separate punishable offense.

 

 

SECTION 4: If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

 

SECTION 5: This ordinance shall take effect and be in force after its passage and publication as provided by law.
