Plan for the establishment of an organized recycling collection service


Please place the following item on the December 11, 2012 City Commission regular agenda:

 

Conduct public hearing for the proposed plan for the establishment of an organized recycling collection service and approve plan, if appropriate.

 

On June 12, 2012, the Mayor signed Resolution No. 6976 announcing the City’s intent to consider adoption of an organized collection service for residential recycling within the City limits of Lawrence, Kansas.

 

As required by the Organized Collection Service Act, K.S.A. 12-2036, the City of Lawrence developed a draft plan for establishing an organized recycling collection service during the 90-day period after the adoption of the resolution of intent.  All interested persons, including licensees and other operating recycling collection services in Lawrence as of June 12, 2012, were invited to participate in the planning of the proposed organized recycling collection service.  Attached is the attendance summary for the three meetings scheduled during the plan development period.

 

Resolution No. 6976 stated the public hearing for the proposed plan for establishment of an organized recycling collection service would be held before the governing body of the City of Lawrence on Tuesday, December 11, 2012.  As required by law, all licensees or other persons operating recycling collection services in Lawrence received 30 days notice prior to the hearing on the proposed plan.  Notice letters were mailed on November 1, 2012.

 

Future steps

Once the public hearing is completed and the plan is approved, the next step will be for the City Commission to consider adopting an ordinance that establishes city-wide residential recycling in Lawrence, as required by K.S.A. 12-2036.  If the ordinance is not adopted by June 12, 2013, one year from the passage of the resolution of intent, the process of establishing an organized recycling collection service shall be started over.

 

The City of Lawrence may not commence the organized recycling collection service for a period of at least 18 months from the adoption of the ordinance.

 

The attached table summarizes the required action steps the City of Lawrence must complete for the establishment of a residential curbside recycling program as required by K.S.A. 12-2036.
