ORDINANCE NO. 8822

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS CONCERNING PARKING AT 700 NEW HAMPSHIRE STREET, ENACTING SECTION 17-312 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2011 EDITION AND AMENDMENTS THERETO.

 

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section 1.  Chapter 17, Article 3, Section 17-312, of the Code of the City of Lawrence, Kansas, 2011 Edition and amendments thereto, is hereby enacted to read as follows:

 

17-312             Parking at 700 New Hampshire Street, Lawrence, Kansas  

 

(A) The City is entering into an agreement to lease 700 New Hampshire Street, and the adjoining parking lot, from Lawrence Store No. 203, L.L.C., beginning on October 1, 2012, and continuing until the completion of the Lawrence Public Library renovation project.

 

(B) To provide for the health, safety and welfare of the public, the City shall exercise administration and control of the Parking Lot adjoining 700 New Hampshire Street during the course of the lease agreement.

 

(C) During the course of the lease agreement, the parking lot adjoining 700 New Hampshire Street shall be designated as a two (2) hour parking lot.

 

(D) It shall be unlawful and a violation of this article for any person to cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to park overtime it the parking lot adjoining 700 New Hampshire Street, Lawrence, Kansas, as designated by appropriate signage. Violation of this subsection (A) shall be prosecuted and adjudicated pursuant to Section 17-304.

 

(E) Chapter 17, Article 3, Section 17-312, shall only be in force and effect until the lease agreement between the City and Lawrence Store No. 203, L.L.C., for 700 New Hampshire Street terminates.

 

 

Section 2.       Severability.     If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

 

Section 3.       Effective Date.     This ordinance shall take effect and be in force upon its passage and publication once in the official city paper as provided by law.
