RE:	Calculations for Z-3-8-11 Protest Petition

Protest petitions were filed in the City Clerk’s Office on August 8, 2011 pertaining to the referenced request for rezoning.  The petitions have enough signatures of the record owners of property in the required notification area to constitute a valid protest petition.  The property owner notification list prepared by the Douglas County Clerk’s Office included parcels lying within 1000’ of the property in the rezoning application request. 

There are twenty-one (21) parcels captured within the required 1000 feet (200 feet on the east boundary since the subject property touches incorporated land within the city limits of Lawrence) notification distance of the property in the rezoning request.  The total area of the real property represented by these 21 parcels is 7,148,368.36 square feet (164.1 acres). The protest petitions received by the City were signed by owners of 15 parcels but only 13 parcels could be counted toward the determination of the petition’s validity.  The total area represented by the 13 parcels counted in the petition is 3,588,566.78 square feet (82.38 acres) or approximately 50.2% of the real property within the notification area.  The protest petition is valid because it bears a sufficient number of property owner signatures within the required notification area to meet or exceed the minimum 20% of the real property required by Code to constitute a valid protest petition. 

Pertaining to the 2 parcels not counted in the calculation of the petition’s validity, they are located beyond the 1000 feet notification area. 

The attached map illustrates the properties within the protest area whose owners are protesting this rezoning request. 

The calculations for determining the validity of the petition are shown below:
