RE: Verizon Wireless, Permanent Utility Easement Agreement

Recently the City entered into a License Agreement with Alltel Communications, LLC d/b/a Verizon Wireless, a Delaware limited liability company, whereby, as part of a program to complete a portion of a state-wide fiber optic network, Verizon Wireless will place and to install fiber optic cable lines in the City's rights of way, traversing south on East 800 Road, then east on U.S. Highway 40/6th Street (entering the City), then south on Wakarusa Drive, and then east on Clinton Parkway/23rd Street (exiting the City). In exchange for the use of the City's rights of way, the City will receive 1 1/4" conduit, installed along the entire route within the City, and the installation of 32 hand-holes.
As part of that agreement, Verizon Wireless has also requested a permanent utility easement across a portion of the City's property at 2121 Wakarusa Drive, which houses Fire Station No. 4. In exchange for that easement, Verizon Wireless has agreed to provide and install for the City two 1 1/4" o.d. SDR-11 HDPE innerducts with a pull rope approximately 300 linear feet in length along the north line of the easement area and to install one handhole at a location to be selected by the City.
Authorize the City Manager to execute a Permanent Utility Easement Agreement with Alltel Communications, LLC d/b/a Verizon Wireless, a Delaware limited liability company, granting it a permanent utility easement across City's property, 2121 Wakarusa Drive (Fire State No. 4), in exchange for the provision and installation of conduit along the easement area and the installation of one handhole at a site selected by the City, all in accordance with the terms of the Permanent Utility Easement Agreement.
