Background
On May 15, 2012, staff presented Resolutions No. 6972 (unsafe structures) and No. 6973 (exterior yard violations) for review. At the conclusion of staff’s presentation, comment from Brian Barland and the public, the City Commission adopted both resolutions. The date of July 24, 2012, was set for an update to be provided on the progress of the exterior yard clean up and the plan to either rehabilitate or demolish the structures.
Staff informed the City Commission that the exterior yard violations had been corrected thus eliminating the need for the City to abate the code violations. In addition, staff advised the Barland family had not provided staff any relevant information regarding their plan to rehabilitate the structures or the possibility of selling the property. Consequently, staff recommended the City Commission initiate the administrative process for the demolition of the structures by submitting the required documents to HRC for their review.
After staff’s update, Brian Barland addressed the City Commission and asked for the item to be deferred for three weeks. Mr. Barland stated his family had recently spoken to Mike Myers, AIA, with Hernly & Associates and Mr. Barland believed he could bring back detailed information on viable options for the family to consider in determining whether to rehabilitate the house, garage and barn or to sell the property to someone who could successfully accomplish the rehabilitation of the structures in question.
The City Commission advised staff to not initiate the demolition of the structures as they agreed to allow Mr. Barland three more weeks to obtain additional information on the feasibility of rehabilitating the structures versus his family selling the property.
