BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, IN THE MATTER OF THE VACATION OF 50’ OF RIGHT-OF-WAY ON KANSAS HIGHWAY NO. 10 (EAST 23RD STREET) FOR MCCONNELL ADDITION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.
NOW on this 24th day of July 2012, the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:
1. The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-504 et seq. as amended.
2. That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.
3. That no private rights will be injured or endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.

BEGINNING AT THE NORTHEAST CORNER OF LOT 1 OF A FINAL PLAT OF MCCONNELL ADDITION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 88°03’08” WEST ON THE NORTH LINE OF SAID LOT 1, AND THE SOUTH RIGHT-OF-WAY LINE OF KANSAS HIGHWAY NO. 10 (EAST 23RD STREET), A DISTANCE OF 201.87 FEET TO THE NORTHWEST CORNER OF SAID LOT 1; THENCE NORTH 01°30’48” WEST ON THE WEST LINE OF LOT 1 EXTENDED, A DISTANCE OF 50.00 FEET; THENCE NORTH 88°03’08” EAST, A DISTANCE OF 201.88 FEET TO THE EAST LINE OF SAID LOT 1 EXTENDED; THENCE SOUTH 01°30’29” EAST ON THE EAST LINE OF SAID LOT 1 EXTENDED, A DISTANCE OF 50.00 FEET TO THE POINT OF BEGINNING, CONTAINING 0.232 ACRES MORE OR LESS, ALL IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, SUBJECT TO RIGHTS-OF-WAY, EASEMENTS AND RESTRICTIONS OF RECORD.
is hereby vacated. Provided that the Governing Body reserves an easement for utilities on/over/under the vacated right-of way.
