Staff suggests the Mayor and City Commission consider the following outline and presentation order for the HRC appeal and the incentive discussion for the proposed 9^th and New Hampshire project on the agenda for June 26, 2012:

• Introduction of court reporter
• Disclosure by the City Commission of ex parte communications on the issue
• Review of legal standards
• Staff overview of HRC determination (Lynne Braddock-Zollner)
• Staff overview of incentive request (Diane Stoddard)
• Springsted, Inc. summary of financial reports (David MacGillivray and Tony Schertler)
• Applicant presentation (William Fleming and Dan Watkins and others)
• Ron Schneider presentation
• Public comment
• Applicant response
