RE:                  Verizon Wireless License Agreement

As part of a program to complete a portion of a state-wide fiber optic network, Alltel Communications, LLC d/b/a Verizon Wireless, a Delaware limited liability company, wishes to place and to install fiber optic cable lines in the City's rights of way, traversing south on East 800 Road, then east on U.S. Highway 40/6th Street (entering the City), then south on Wakarusa Drive, and then east on Clinton Parkway/23rd Street (exiting the City).

 

City Staff and Verizon Wireless have negotiated a License Agreement, whereby, in exchange for that use of the City's rights of way, Verizon Wireless has agreed to provide to the City and to install 1 1/4 inch conduit along the entire length of the above-described route from East 800 Road to East 1750 Road. Verizon Wireless has also agreed to install 32 hand-holes at locations pre-selected by the City.

 

Currently, Verizon Wireless will not use the fiber optic cable to provide telecommunications services to local customers. If that changes in the future, Verizon Wireless agrees to enter into a contract franchise with the City in accordance with state law.

 

Requested Action:

Authorize the City Manager to execute a License Agreement with Alltel Communications, LLC d/b/a Verizon Wireless, a Delaware limited liability company, allowing it to place fiber optic cable in the City's right of way in exchange for the provision and installation of conduit from the intersection of East 800 Road and U.S. Highway 40, east on U.S. Highway 40/6th Street to Wakarusa Drive, south on Wakarusa Drive to Clinton Parkway, east on Clinton Parkway/23rd Street to East 1750 Road, and the installation of 32 hand-holes at sites selected by the City, all in accordance with the terms of the License Agreement.
