RE:

Shots Sidewalk Dining License

Section 6-1202 of the City Code requires sidewalk dining licensees to comply with all applicable zoning regulations, including the 55% food sales requirement [other than “grandfathered” drinking establishments, all drinking establishments in the downtown district must derive at least 55% of sales from food and non-alcoholic beverages, per City Code Section 20-509(5)]. Section 6-1202.5 of the City Code requires the licensee to make copies of the sales and liquor tax forms available to the city at any time.

Shots LLC has submitted all of the paperwork required to apply for a sidewalk dining license. This is a new drinking establishment and therefore has not established a track record of meeting food sales requirements. Staff therefore recommends that the sidewalk dining license be issued with the condition that the licensee supply copies of their completed and filed State of Kansas sales and liquor tax forms to the City Clerk’s Office each month within ten days of filing the forms with the State of Kansas.
