SE-4-15-12: A Special Event request for a Cinco de Mayo/Poehler Open House public outdoor concert on the vacant property located at 800 Pennsylvania Street. Submitted by Tony Krsnich, for Ohio Mortgage Investors, LLC, property owner of record.

Recommendation:  Planning Staff recommends approval of the Temporary Special Event for a Cinco de Mayo celebration at 800 Pennsylvania Street for the following date and time:

May 5 (Saturday) from 1 pm to 9 pm

subject to the following conditions:

  1. The Special Event Permit must be displayed on site during hours of operation.
  2. Temporary sign permit must be obtained from Development Services for proposed temporary signage.
  3. Any structures must be removed within 24 hours after the cessation of the event.
  4. The applicant shall provide trash receptacles or other sanitation provisions as needed.

5.    Ensure the construction areas for the Poehler building are cordoned off to avoid safety issues with those attending the event.

6.    The applicant shall apply for and receive a temporary occupancy permit to accommodate tours of the Poehler apartment building.

7.    Install a barrier around the perimeter of the alcohol serving area and the perimeter of the event area.

 

STAFF REVIEW

A Temporary Special Event Permit has been requested to allow for a Cinco de Mayo public concert event to be held on vacant property at 800 Pennsylvania Street. The applicant, the Ohio Mortgage Investors, LLC, has indicated that this event will include an open house for the opening of the Poehler Lofts apartments.

 

The event will be a public concert that will take place on private property.  There is no request to use the public right-of-way associated with this event.  Alcohol will be served.  There will be no merchandise sales and tents will not be used.  The event will also include tours of the Poehler Lofts.  The tours will only include those areas that receive approval for a temporary occupancy permit.

 

The Special Event is considered to be a Type 5 event.  Article 15 of Chapter 6 of the City Code regulates Temporary Special Events. Per Code, a Type 5 Special Event Permit requires City Commission approval.  Type 5 events are public events primarily for entertainment or amusement, such as concerts or festivals.

 

The proposed event will occur on Saturday, May 5th. The event will take place between 2pm and 8pm.  The request is from 1pm to 9pm to allow for extra time for early arrivals and folks that stay later talking. 

 

The applicant has indicated that their management company, Yarco, has 20 people that will assist with security and clean up.  The applicant has indicated that numerous portable toilets will be available.  The applicant is also seeking a Temporary Alcohol License.


On-street parking will be utilized for the event.  It is anticipated that many attendees will walk to the event.

 

The Special Event Permit request was forwarded to the various City Departments for review.  The only concern raised was to ensure the construction areas around the Poehler building are cordoned off to avoid safety issues with those attending the event and tour of the Poehler building.

 

Any signs associated with the event must be compliant with the sign regulations. Approval of this Special Event does not include sign approval. A separate application for signs should be made to the Development Services as applicable to the event.

 

The event should have minimal negative impact on neighboring properties as it will start in the afternoon on Saturday and will conclude by 9pm.  Further, the stage will face away from the bulk of the residential properties in the area.
